Settlement of Cases

A focused study of Chapter XIVA of the Customs Act 1962 — covering the Settlement Commission framework, eligibility to apply, procedure for settlement, powers to grant immunity from prosecution and penalty, and the finality of settlement orders — a precise, regularly tested area in the CBLE.

Course Overview

This course covers the Settlement of Cases framework under Chapter XIVA of the Customs Act 1962 — Sections 127A through 127N — which provides an alternative dispute resolution mechanism allowing persons involved in customs duty evasion to voluntarily disclose their true liability and settle their case before the Customs and Central Excise Settlement Commission, in exchange for which immunity from prosecution and reduction of penalty may be granted. The Settlement Commission route is distinct from the regular appellate hierarchy covered in Course 34 and is available only under specific eligibility conditions — a distinction CBLE tests with precision
